These Terms and Conditions govern your use of the website, services, campaigns, and all digital marketing activities operated by Prop Nexus Global FZE ("Company", "we", "our", or "us"), a company registered and operating in Dubai, United Arab Emirates.
References to "Client", "you", or "your" refer to any individual, business, developer, brokerage, or entity that accesses this website or engages the Company's services
Scope of services
Prop Nexus Global FZE provides performance marketing and lead generation services for the real estate sector, including but not limited to:
Real estate lead generationLuxury real estate marketingOff-plan project marketingMeta and Google Ads managementCampaign strategy and optimisationCRM and funnel consultationLanding page developmentCreative production and brandingPerformance marketing services
All services are delivered based on mutually agreed proposals, campaign scopes, or written service agreements. Verbal commitments do not constitute binding service agreements unless confirmed in writing.
Payments and billing
All invoices issued by Prop Nexus Global FZE are due within the payment period stated on the relevant invoice or proposal. Late or missed payments may result in immediate service action, including:

The Company reserves the right to withhold deliverables, campaign access, creatives, reports, and platform account access until all outstanding dues are settled in full. Disputes over invoiced amounts must be raised in writing within 7 days of invoice issuance.
Non-refundable payments
Due to the digital and performance-based nature of advertising services, all payments made to Prop Nexus Global FZE are strictly non-refundable once work has commenced or campaigns have been activated.
Company fees (non-refundable)
Consultation fees, setup fees, retainers, creative production, strategy development, media buying fees, and campaign optimisation charges.
Third-party ad spend (non-refundable)
All advertising spend paid toward Meta, Facebook, Instagram, Google Ads, YouTube, LinkedIn, TikTok, and any external ad network.
Third-party platforms control the deployment, delivery, and billing of ad spend independently. The Company has no ability to recover funds committed to or spent on these platforms on the client's behalf.
Lead generation disclaimer
Prop Nexus Global FZE generates qualified marketing leads and buyer inquiries for developers, brokerages, and real estate businesses. While the Company applies commercially reasonable efforts to optimise lead quality and campaign performance, we do not guarantee any of the following outcomes:
Property sales / Transaction closures / Booking or reservation conversions / Investor commitments / Guaranteed ROI or revenue outcomes
Campaign performance is influenced by variables outside the Company's control, including project pricing, inventory availability, prevailing market conditions, sales team response speed and quality, geographic targeting limitations, competitor activity, and buyer demand cycles.
Lead quality metrics are benchmarked against agreed qualification criteria. Any performance benchmarks referenced in proposals are indicative estimates based on comparable campaigns and do not constitute guaranteed outcomes.
Client responsibilities
The client is solely responsible for all activities that occur after a lead is delivered, including:
Sales handling and follow-upCRM managementBuyer communicationClosing transactionsLegal documentationProject regulatory complianceAccuracy of project information
The Company shall not be held liable for missed sales opportunities resulting from delayed responses, poor sales handling, inaccurate project information provided to leads, or failure to follow up in a timely manner. The client warrants that all project information, pricing, and marketing materials shared with the Company are accurate, lawful, and compliant with applicable UAE regulations.
Advertising platform disclaimer
Prop Nexus Global FZE operates campaigns on third-party platforms including Meta, Google, Instagram, YouTube, LinkedIn, TikTok, and similar advertising networks. These platforms operate independently and may modify their policies, algorithms, or performance variables at any time without notice.
The Company is not responsible for platform-side events including but not limited to: account restrictions, ad disapprovals, reach or delivery fluctuations, CPM or CPL changes, policy enforcement, targeting limitations, or platform downtime.
Where a platform restricts or suspends a campaign for reasons outside the Company's control, the Company will make reasonable efforts to resolve the issue but cannot guarantee restoration of campaign performance within a specific timeframe.
No performance guarantees
The Company does not guarantee specific performance outcomes for any campaign, including first-page Google rankings, SEO positions, viral social media reach, exact lead volumes, exact cost per lead, or specific engagement metrics.
All digital marketing outcomes are subject to market dynamics, platform behaviour, and competitive conditions that are outside the Company's direct control. Any figures cited in proposals or case studies are illustrative of past performance and are not warranties of future results.
Intellectual property rights
Unless otherwise agreed in a separate written agreement signed by both parties, all creative assets, designs, ad copy, landing pages, campaign structures, funnels, strategies, branding assets, reports, and presentations developed by Prop Nexus Global FZE remain the sole intellectual property of the Company.
Clients may not reproduce, redistribute, resell, modify, sublicense, or reuse any proprietary materials produced by the Company without prior written permission. Upon full settlement of all outstanding fees, the Company may transfer agreed deliverables to the client as specified in the relevant service agreement.
Confidentiality
Both parties agree to treat as confidential all non-public information exchanged in connection with the services, including business strategies, pricing structures, advertising performance data, customer data, campaign results, proprietary methodologies, and financial information.
Neither party shall disclose confidential information to any third party without the prior written consent of the other party, except where disclosure is required by applicable law, court order, or regulatory authority. This obligation survives the termination of any service agreement.

The Company's total aggregate liability in connection with any claim shall not exceed the total amount paid by the client to the Company during the three-month period immediately preceding the event giving rise to the claim.
Nothing in these Terms limits liability for fraud, wilful misconduct, or any matter that cannot be excluded under applicable law.
Indemnification
The client agrees to indemnify, defend, and hold harmless Prop Nexus Global FZE and its directors, employees, and contractors against any claims, damages, liabilities, losses, penalties, or legal costs arising from or related to:
Misleading or inaccurate project informationNon-compliant advertising contentRegulatory violations by the clientProperty or title disputesClient negligence or misconductUnauthorised claims made about a project
This indemnification obligation survives the termination of any engagement with the Company.
Dispute resolution and governing law
These Terms and Conditions are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising out of or in connection with these Terms, or any services provided by the Company, shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
Before initiating formal legal proceedings, both parties agree to make a good-faith effort to resolve any dispute through direct negotiation within 30 days of written notice of the dispute. If unresolved, either party may proceed with formal legal action.
Amendments to these terms
Prop Nexus Global FZE reserves the right to update or amend these Terms and Conditions at any time. Where material changes are made, the Company will update the effective date displayed at the top of this page. Continued use of the website or services after any amendment constitutes acceptance of the revised terms.
Clients are encouraged to review these Terms periodically. If you do not agree with any changes, you should discontinue use of the website and notify the Company in writing.
